Four people who contested against Sir Allan in the recent bye-election had written to the Speaker of Parliament Sir Peter Kenilorea asking him not to administer yesterday morning's swearing-in ceremony.
They say Sir Allan is still serving a 12 month suspended sentence, the very reason that took him out of Parliament.
They say despite having won the majority votes in the bye-election, which did not over-ride the fact that section 49 of the constitution disqualifies Sir Allan's membership.
A lawyer in Honiara who spoke to Solomon Star has made a similar argument against Sir Allan.
The lawyer says the 12-month suspended prison sentence which took Sir Allan out of Parliament is still in effect.
